New Yorkers Support Gay Marriage

(New York City) In the first survey of New Yorkers since a judge ruled that a state ban on gay marriage violated the New York Constitution a majority of people say same-sex couples should be allowed to marry.

But, the survey also showed support for Mayor Michael Bloomberg's appeal of the ruling.

The Quinnipiac University Poll found that 51 percent of respondents said they favored legalizing gay marriage, while 40 percent were opposed.

However, when asked about the appeal, 49 percent said they agreed with Bloomberg's strategy with 44 percent opposed.

Last month State Judge Doris Ling-Cohan ruled that the New York State Constitution guarantees basic freedoms to lesbian and gay people, and that those rights are violated when same-sex couples are not allowed to marry.

A day later Bloomberg said that while he believes such marriages should be permitted, "If we did not appeal this I think we would have chaos in this city."

In another same-sex marriage case a judge in Ithaca dismissed a challenge by 25 same-sex couples to the state's ban on gay marriage.

Judge Robert C. Mulvey ruled that same-sex marriage is the sole prerogative of the Legislature not the courts.

With Bloomberg's appeal of the New York City ruling the final decision on gay marriage in the state will be left to the Court of Appeal which will hear the case later this year.

The Quinnipiac poll found there is a racial divide on the issue of same-sex marriage with 61 percent of whites in favor of allowing gays to marry, compared with just 36 percent of blacks.

The poll surveyed 1,435 New York City registered voters between February 22 and March 1. It has a margin of error of plus or minus 2.6 percentage points.

"We're gratified to see a majority of New York City residents supporting marriage for same-sex couples," Michael Adams, a spokesperson for Lambda Legal told 365Gay.com.

"It shows growing support for what is only rights and fair."

Lambda represented same-sex couples in their suit in New York City and will fight Bloomberg's appeal of the case.
